Binny's Tote Rental — Equipment Rental Agreement

Version 4.8 · binnys.ca

1. Definitions

Customer means the individual or entity renting equipment from Binny's.

Rental Unit means one 102L HDX tote together with its matching lid, treated as one complete rental unit.

Rental Period means the agreed rental term shown on the invoice.

2. Agreement

By placing a reservation, accepting delivery, making payment, or electronically accepting these terms, the Customer enters into this Agreement with Binny’s Tote Rental.

3. Rental Period

The standard rental period is fourteen (14) calendar days unless otherwise agreed in writing. The rental begins on the scheduled delivery date and ends on the scheduled pickup date.

4. Delivery & Pickup

The Customer agrees to provide safe and unobstructed access. Rental Units must be empty, reasonably clean, and placed at the agreed pickup location by 8:00 a.m. on pickup day unless otherwise instructed.

5. Rental Units

Rental Units remain the property of Binny’s at all times. The Customer shall not modify, mark, drill, cut, paint, or otherwise alter any Rental Unit.

6. Customer Responsibilities

The Customer agrees to use Rental Units only for ordinary household moving and storage, exercise reasonable care, protect them from theft, and promptly report any loss or damage.

7. Rental Extensions, Late Returns & Non-Return

Extension requests must be submitted before the scheduled pickup date. Approval is subject to inventory availability and is not guaranteed. Approved extensions are charged according to Binny’s current published pricing. Failure to make Rental Units available on the scheduled pickup date without approval constitutes an unauthorized late return, and the process set out in this Section applies.

Pickup reminder. Approximately forty-eight (48) hours before the scheduled pickup date, Binny’s will as a courtesy send a reminder by text message and/or email stating the expected pickup window. The Customer may call Binny’s at the number shown on that reminder to arrange a different pickup time. The reminder is a courtesy only: failure to send, receive, or read it does not waive the Customer’s obligation under Section 4 to have the Rental Units empty and placed at the agreed pickup location by 8:00 a.m. on the scheduled pickup date.

Non-return notice. If the Rental Units are not available when Binny’s attempts pickup, Binny’s will document the attempt and send a non-return notice by both text message and email to the mobile number and email address on file. The three (3) day response period runs from the time that notice is sent, not from when it is received or read.

If the Customer responds within three (3) days. Where the Customer responds within the response period and arranges the return of the Rental Units, an additional-visit fee of $25.00 applies for each further pickup visit Binny’s must make, together with a late-return charge for the period beyond the scheduled pickup date. The late-return charge is billed in whole weeks at the package’s additional-week rate, is not prorated, and the first additional week begins on the day following the scheduled pickup date.

If the Customer does not respond within three (3) days. Where the Customer does not respond within the response period, or does not make the Rental Units available at an arranged time, the outstanding Rental Units and equipment are deemed lost and not returned, and the replacement fees in Schedule A apply. Replacement fees are charged per outstanding item: items already returned are not charged. Once a replacement fee is charged for an item, late-return charges for that item stop accruing.

Return after a replacement fee. If Rental Units for which a replacement fee has been charged are returned to Binny’s empty and in good condition within thirty (30) days of that charge, Binny’s will refund the replacement fee for those units, less any additional-visit fees and late-return charges accrued and less any damage or excessive cleaning fees that apply. Rental Units returned more than thirty (30) days after the replacement fee is charged are not refundable.

Charges under this Section are applied to the payment method on file in accordance with Section 10. If that payment method declines or is no longer valid, the Customer remains liable for the amounts owing and Binny’s may issue an invoice payable on receipt. Nothing in this Section limits other remedies permitted by Ontario law.

8. Damage & Replacement

Normal cosmetic wear is expected. If Rental Units or other supplied equipment (including dollies) are lost, stolen, destroyed, not returned, or damaged beyond normal wear and tear, fees apply in accordance with Schedule A — Damage & Replacement Schedule.

The per-item amounts in Schedule A are maximums. For any Rental Unit or dolly that is lost, stolen, not returned, or damaged beyond repair, Binny’s will charge no more than $15.00 per Rental Unit and $100.00 per dolly, plus applicable taxes, however long the item is outstanding.

9. Cleaning

Rental Units must be returned empty and reasonably clean. Additional cleaning fees may apply where excessive cleaning is required.

10. Payment Authorization

The Customer authorizes Binny’s to securely retain and use the payment method provided to collect rental charges, approved extension fees, damage fees, replacement fees, cleaning fees, missed pickup fees, and other charges authorized by this Agreement. Where required by law, Binny’s will provide reasonable notice before processing post-rental charges. Charges for late return and non-return follow the notice and response process set out in Section 7.

11. Photographic Documentation

Binny’s may photograph Rental Units during delivery and pickup to document condition, inventory, and placement. Binny’s may also photograph the pickup location on the scheduled pickup date to document an attempted pickup where Rental Units are not available. Such photographs may be used to resolve disputes.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Binny’s is not responsible for damage to the Customer’s packed contents, improper packing, delays beyond Binny’s reasonable control, or indirect or consequential damages. Nothing herein limits liability where prohibited by law.

13. Assumption of Risk

Moving heavy objects involves inherent risks. The Customer accepts responsibility for safe lifting, loading, transport, and stacking.

14. Privacy

Customer information is collected solely for reservations, deliveries, payment processing, customer service, and legal compliance.

Binny’s website uses a first-party cookie and collects technical information, including IP addresses and browser details, to understand how visitors use the site, to improve the booking experience, to prevent fraud and abuse, and to maintain records of agreement acceptance. This information is stored on Binny’s own systems and is not sold or shared with third parties for advertising. Payments are processed by Stripe, and email and text-message delivery are handled by service providers acting on Binny’s behalf. Marketing emails are sent only with the Customer’s express consent, which may be withdrawn at any time.

15. Governing Law

This Agreement is governed by the laws of Ontario and the applicable laws of Canada.

16. Entire Agreement

This Agreement, together with the invoice and attached schedules, constitutes the entire agreement between the parties.

17. Payment, Cancellation & Travel Charge

At the time of booking, the Customer’s payment method is pre-authorized for the full rental amount. Payment is collected (the card is charged) 48 hours before the scheduled delivery date. For bookings made within 48 hours of the scheduled delivery, payment is collected at the time of booking.

Cancellations are not permitted within 48 hours of the scheduled delivery date. A booking cancelled more than 48 hours before the scheduled delivery is free of charge: the pre-authorization is released and no payment is collected. Within the 48-hour window, cancellations are handled by phone at Binny’s discretion and any collected payment is non-refundable except at Binny’s discretion.

Deliveries and pickups at addresses more than 50 km by driving distance from Binny’s Barrie location incur a travel charge of $0.50 per kilometre for each kilometre beyond the first 50 km, applied separately to the delivery trip and the pickup trip. The delivery and pickup addresses may differ, and each must be within Binny’s service area. The travel charge is calculated and disclosed before payment. Binny’s currently services addresses up to 150 km driving distance from its Barrie base. Binny’s delivers to and collects from physical street addresses only and cannot deliver to or pick up from PO boxes or other non-physical addresses.

18. Order Confirmation & Cancellation by Binny’s

Binny’s may cancel any order at its sole discretion for any reason. If Binny’s cancels an order, any pre-authorization is released and any payment already collected is refunded in full.

Binny’s may contact the Customer by phone, SMS, or email to confirm order details before delivery.
